An interesting copywrite scenario...

So David Lee Roth is doing a morning radio show in Boston this week that im taping...

He played on of his own songs and he sang live over it. It wasnt karaoke style, he sang some chorus and then free-styled over some instrumental parts.

Now I know that the easy answer would be to not include that part (along with cutting out the other songs) if I was going to torrent it (I doubt that there is interest here...) just to be safe....

Could this be considered a gray area? Since what I recorded is a modified version of the song, and not available commercially, is this now fair game?

Any thoughts?

I would say yes, please torrent it. The material being presented was broadcast over air and is not available commercially. Some others may disagree with me, but I say it's a go.

I say yes, go ahead, also. Someone did this recently with a U2 broadcast interview. A couple of U2 songs were played during the interview, but you could hear Bono talking and singing along to them.
