It's definitely that. I can't connect to Yahoo messenger and pages won't load when BC is on. All while it's only DL at 40 kbps.

Sympatico, my old ISP, throttled my speeds even worse. I was getting under 10 kbps total (!!!!) before they fixed the problem.

I thought I had virus or spyware.

I ran two virus scans and spybot BTW, before I called tech support.
